A settlement has been reached in the case involving the 2013 death of a woman who had received incorrect medication from a local pharmacy.
Springfield, Missouri, attorney Steven Garner told News-Press Now that the parties in the Joyce Oyler case reached the settlement late Friday.
Garner said he could not provide the terms of the settlement, but he said the agreement is satisfactory to both sides.
Family members filed the lawsuit following Oyler’s death, which occurred after she took a powerful anti-cancer drug from the Hy-Vee Pharmacy in St. Joseph rather than a daily diuretic she should have gotten. Oyler died following her discharge from what was then Heartland Regional Medical Center.
A jury trial had been set to begin today in Judge Patrick Robb’s courtroom, with the plaintiffs seeking to prove aggravating circumstances and punitive damages based on the circumstances of Oyler’s death.
