A wrongful death lawsuit has been filed against a local nursing home after a resident allegedly suffered from bed sores and malnutrition that caused his death.

Jeannie Merriott has filed the petition regarding her late husband, John Merriott, who was a resident at Abbey Woods Rehabilitation and Healing from Nov. 5 to Nov. 27, 2018. John Merriott was accepted to the nursing home after suffering from a stage 3 pressure ulcer, also known as a bedsore, according to the lawsuit. The man also was reported as being diabetic at the time of his admittance.

The man is said to have developed more bed sores and saw his original sore worsen, also developing nutrition and hydration problems while in the care of Abbey Woods, the lawsuit states. John Merriot died on Nov. 30, 2018, three days after he is reported as leaving the nursing home’s care.

Jeannie Merriot has filed counts of negligence related to wrongful death, Missouri Omnibus Nursing Home Act violations, an alternative lost chance of recovery or survival claim and personal injury against Abbey Woods and its owner, AW Operations LLC.

The case is scheduled to be heard by Judge Kate Schaefer at 9 a.m. Monday, Dec. 16.
