Testimony ends in child rape case

MAYSVILLE, Mo. - A DeKalb County jury heard a final day of testimony Monday in a child sexual assault case from Livingston County.
A tearful and sometimes breathless Scott Eckert, 33, spent Monday afternoon on the witness stand. When asked by Rick Hanson, a defense attorney, Mr. Eckert turned and told the jury he didn't have sex with or hurt the victim, a minor under the age of 10.
The crime was alleged to have occurred in May 2007 near or in Mr. Eckert's home in Chula, Mo. He was arrested last year and charged with rape, statutory rape, tampering with physical evidence and endangering the welfare of a child.
Mr. Eckert also delivered the same message when asked by Mike Koenig, the Livingston County prosecuting attorney.
Mr. Koenig brought up the fact that a number of books, videos and magazines of a pornographic nature were found in the house where the crime allegedly occurred.
"No sir, I wouldn't waste my money on this junk," Mr. Eckert told the prosecutor. He also maintained he'd never seen the books and that the videos and magazines belonged to a brother.
The state challenged changes in Mr. Eckert's testimony, but the defense cited the emotional frailty of the defendant because of the charges, family problems and his father having a heart attack during the investigation.
Mr. Eckert responded to questions from the prosecutor and his attorney for more than two hours Monday. At one point, he clutched a piece of paper in his hand as he spoke and his tear-filled eyes seemed to require frequent blinking behind his glasses.
Livingston County Circuit Judge Warren McElwain told the DeKalb County jury that each side would have an hour today for closing arguments before he put the case in their hands.
